Family-Based Immigration
Two factors will determine your path to a family-based green card, which will allow you to live and work in the U.S. on an indefinite basis so long as you continue to renew.
These two factors are:
- Whether or not you are eligible
- Whether you are applying from inside or outside the U.S.
Eligibility for Family-Based Visas
Only certain individuals are eligible to apply for a green card through family connections. This is based on whether the family member who sponsors your petition is a U.S. citizen or a permanent legal resident (green card holder). These individuals can apply on a preference basis, starting with first preference for the spouses, unmarried children under the age of 21, and the parents of a U.S. citizen who is at least 21, known as “immediate” relatives. Other family members of U.S. citizens who may be eligible include unmarried sons and daughters aged 21 and older and married sons and daughters (third preference), and the siblings of a citizen who is at least 21 (fourth preference}.
Second preference eligibility includes the spouses and children under the age of 21 of green card holders, as well as the unmarried sons and daughters aged 21 or older of green card holders.
Other family-based immigration categories include the fiancé(e)s of U.S. citizens and their children, widows and widowers of U.S. citizens, and the abused spouses, children, or parents of U.S. citizens.
Family-based immigration generally involves two applications, an immigrant petition and an application for a green card. The family member who is sponsoring you generally files the petition on your behalf.
Consular Processing
You may apply for family-based immigration within the U.S. through an Embassy, or outside the U.S. in your home country through a U.S. Department of State consulate. You must file your petition and documentation at the consulate in your area abroad, and then wait for a decision from the U.S. Citizenship and Immigration Services (USCIS).
